Law firm to assist in hospital closing

LANCASTER - A Lexington law firm will assist Garrard County Fiscal Court in the closing of Garrard County Memorial Hospital, and the transfer of assets regarding the hospital and the Long Term Care Facility - but only if the county attorney needs them to.

"I will be handling the county's interests in the winding down, unless it gets in areas where I don't have expertise," said County Attorney Jeff Moss.

The firm of Gess, Mattingly, and Atchison will be paid between $125 and $200 an hour for their services. The county will be billed monthly for legal services and expenses.

Moss said the county has not necessarily hired the law firm, but he said they are there to handle litigation on an "as needed" basis.

According to the letter from Joseph H. Miller, an attorney with Gess, Mattingly and Atchison, primary responsibility in representing the county's interest in the hospital and long term care facility will remain with Moss. Miller writes that "included in our representation, if requested by the Garrard county Attorney, is the defense against any claims or causes of action involving Garrard County....relating to or associated with the suspension of services or transfer of...assets of either (the hospital or long term care facility.)"

The letter was signed by Judge-Executive E.J. Hasty, members of the fiscal court and Moss.

The firm will also prosecute any counterclaims, cross claims or claims of offset that many arise in the wake of the processes regarding the hospital and long term care facility. |None***
