A woman who was accused with her husband in November 2002 of trying to sell her baby in Danville has been ruled incompetent to stand trial.
Criminal charges against Kathy Lee Hart, 36, of Somerset, were dismissed earlier this week after two competency evaluations recommended she is not able to stand trial. Commonwealth's Attorney Richard Bottoms said her case now takes a different route.
"The statutes mandate a certain procedure for involuntary hospitalization, and that process is beginning now," said Bottoms, who added that charges against Hart's husband, Anthony Lee Hart, 39, also of Somerset, will proceed.
"The charges against Mrs. Hart can be reinstated if she becomes competent to stand trial."
Anthony Hart's next hearing is March 3 before Boyle Circuit Judge Darren Peckler. Hart is charged with attempting to sell a child for adoption, a Class D felony carrying a maximum penalty of five years in prison if convicted.
