STANFORD - A man originally charged with 65 counts of rape and 24 counts of first-degree sexual abuse of a minor accepted a plea agreement last week on an amended indictment, and is now waiting for formal sentencing. The prosecution recommended 22 years in prison.
Marvin Phipps, 38, 1450 Cemetery Road, Waynesburg, appeared before circuit Judge Jeffrey Burdette on six counts of second-degree rape and six counts of first-degree sexual assault. The indictment stems from charges involving two children in Lincoln and Pulaski counties. Phipps had allegedly forced the 12-year-old girls to perform perverse sexual acts, starting with an assault in 1999.
According to statements made by the victims, Phipps waited until the family was gone before engaging in predatory sexual behavior. He reportedly lived with one child's mother during the sexual assaults until the victim was hospitalized following a suicide attempt. When his residence was searched, police confiscated a pornographic video, which was reportedly used in the assaults.
