Casey County District Judge Roger Elliott has recused himself from presiding over a vote-buying case that indirectly involves his wife, a former school board candidate.
In a statement filed Tuesday, Elliott disqualified himself as presiding judge in the case of Edgar Joe Ellis, who is accused of buying a vote in the Nov. 2 race for the District 1 seat on the Casey County Board of Education. John Cox won the race, defeating Sheila Elliott, the judge's wife.
"The presiding judge's wife was a candidate in the election from which this charge arises," Judge Elliott wrote as the reason for his disqualification.
The order has been forwarded to Chief Regional Judge John Knox Mills of Barbourville, who will appoint another judge to hear the case, which is next scheduled for a preliminary hearing on Dec. 7.
