Lawsuit alleges nursing home failed to care for patient

July 19, 2006|TODD KLEFFMAN

A Danville woman has filed a lawsuit on behalf of her grandmother alleging that a local nursing home was negligent in its care of the elderly woman and that negligence ultimately caused her death.

The civil action, filed on behalf of Georgia Ann Edrington, claims Danville Centre for Health and Rehabilitation failed to provide enough trained staff to properly care for Edrington while she was at the facility from Oct. 23, 2005, until her death 10 days later.

Edrington suffered bed sores, infections, pneumonia, severe pain and, finally, death, because of the poor quality of care, the lawsuit alleges.

Marcella Hodges, administrator for the nursing home at 642 N. Third St., did not return several phone calls seeking comment about the lawsuit. A faxed statement from the facility Tuesday said, "As a matter of policy, we do not comment on pending litigation. We are confident we provided good care to this resident."

The complaint was filed in Boyle Circuit Court by Sherry Luttrell, Edrington's granddaughter. It seeks an undisclosed amount of damages for pain and suffering, mental anguish, disfigurement and loss of life, as well as medical and legal costs.

It names Danville Centre for Health and Rehabilitation, parent company Kindred Healthcare Inc. and 10 unknown persons who allegedly provided care to Edrington at the local facility as defendants in the lawsuit.

According to its Web site, Kindred Healthcare is headquartered in Louisville and operates 80 hospitals and 253 nursing homes in 28 states.

The lawsuit alleges the staff at the facility did not make timely and accurate care assessments and did not take action to treat bedsores that Edrington developed. Those bedsores became infected, the lawsuit claims, and contributed to her death.
