March 12, 2007|BRENDA S. EDWARDS

LIBERTY - Former Liberty police officer Joey Miller, who resigned last week, has pleaded guilty to removing evidence from a vehicle at the police department without legal authorization.

A criminal complaint filed Tuesday accused Miller, 43, of Jamestown of removing the evidence from the car on Oct. 30 and of taking 41 various music CDs belonging to Mark McKaig.

Miller pleaded guilty to the misconduct charge Tuesday in Casey District Court. It was merged with a charge of theft by unlawful taking under $300. Both are misdemeanors.

Miller was sentenced to 60 days in jail by Judge Michael Loy. The sentence was suspended, and Miller was placed on probation for two years.

In addition to resigning from Liberty Police Department, Miller permanently surrendered his police officer certification as part of the judgment.

Miller was suspended from duties Jan. 11 after Kentucky State Police began investigating the allegations against him.

He was on paid leave until his resignation March 1. The City Council accepted his resignation Monday, the day before he appeared in district court.

KSP Detective Tim Simpson of Bowling Green conducted the investigation.
