Garrard day care loses license

LANCASTER - The emergency suspension order issued Aug. 6 to Learn and Play Daycare LLC near Bryantsville has been affirmed.

An appeal hearing that had been scheduled for today in Frankfort was cancelled after owner Lesia Pietrzak failed to get an attorney to appear on behalf of the business.

According to the dismissal order issued by the state Cabinet for Health and Family Services, the suspension order is final and the business is no longer licensed to care for children.

State law requires a corporation, limited liability company or other artificial entity to be represented by an attorney in an administrative proceeding, according to the dismissal notice signed by Robert G. Layton, administrative law judge.

An attorney did not enter an appearance for Learn and Play Daycare by the 4:30 p.m. Monday deadline.

Pietrzak can appeal the decision to circuit court if she chooses.

The suspension order was issued after state officials determined an immediate threat existed to the children's safety and the center did not provide adequate supervision.

After the initial investigation, the cabinet said the center had exceeded required staff-to-child ratios and maximum group size, surpassed the maximum number of children in two classrooms, and failed to provide for the children's health, safety and welfare.

In its final report, the state agency cited three problems: inappropriate discipline and inadequate staffing and supervision.

Before Learn and Play Daycare closed, Pietrzak applied for another license to operate another day care on Lexington Street in Lancaster.

That application has not been processed.

Pietrzak reportedly planned to open Learn and Play Daycare II at the site of Tot Spot Day Care, 235 Lexington St.
