Franklin Circuit Judge Roger Crittenden on Wednesday denied a motion by attorney Ed Dove to amend a complaint by local nonprofit Clark County Citizens for Quality Education in the group's lawsuit against the Clark County Board of Education.
The motion would have added the phrase "arbitrary and capricious" to describe the the school board's approval of its district facilities plan; in the original complaint, that language is only used to describe the decision of the Kentucky Board of Education to approve the plan.
"I think it's becoming apparent to Mr. Dove that his claim is in trouble," said Larry Bryson, attorney for the school board, adding that the change is "just an attempt to delay this (case) further."
