Garrard man faces federal firearm charges

February 27, 2008|TODD KLEFFMAN

LEXINGTON - A Garrard County man has been indicted by a federal grand jury on three counts related to possession of a firearm.

Hargus Edgar Gabbard of 333 Daughters Lane is charged with being a convicted felon in possession of a firearm, violating a domestic violence order by having the gun, and having the gun after being convicted of misdemeanor domestic violence.

The indictment, handed up earlier this month in U.S. District Court in Lexington, stems from Gabbard's arrest in Boyle County on Dec. 16.

Gabbard was under a domestic violence order from Boyle Family Court prohibiting him from owning a gun. The order was issued Nov. 15 and in effect through November 2010.

Boyle Deputy Sheriff Jody Adams said Gabbard's estranged wife, who had moved from Garrard County to Junction City, reported that Gabbard had threatened her and her family and shown a gun to another family member.

The alleged gun violations were called to the attention of the federal Bureau of Alcohol, Tobacco and Firearms, and the decision was made to prosecute on the federal level, where conviction can lead to stiffer penalities, Adams said.

Gabbard also was convicted of misdemeanor domestic violence in Casey County in 1996, according to court records.

If convicted, Gabbard faces a maximum sentence of 10 years in prison.
