Breaking news: Third arrest made in Shangraw/Upton murder case

August 05, 2008

Deonte Lamont Simmons, 25, of Richmond, Tuesday became the third person arrested in connection with the Feb. 1, 2002 Lincoln County murders of Ryan Shangraw and Bo Upton.

Simmons has been charged with two counts of murder, two counts of attempted murder, two counts of first-degree robbery and one count of first-degree burglary.

Simmons is incarcerated at the Western Kentucky Correctional Complex in Fredonia on unrelated charges. The arrest stems from a Lincoln County indictment that was served on Simmons by Det. Monte Owens.

Second arrest came July 29

After years without a break, detectives from Kentucky and Tennessee arrested Matthew James Tolson in Sevierville, Tenn., on July 29, said Gary McCarter, who says he is the suspect's father-in-law.

According to an arrest log published online by The Mountain Press in Sevierville, Tenn., Tolson was charged with being a fugitive from justice and jailed.

A spokesperson at the Sevier County Jail said Tolson was jailed there July 29 and extradited to Kentucky on July 31. She declined to give any other information.

McCarter said Tolson is held at the Lincoln County Regional Jail. A jail spokesperson declined comment.

Tolson's wife, Heather McCarter, is visiting the suspect's aunt in Danville, hoping for a face-to-face visit with her husband in jail, Gary McCarter said.

McCarter said Tolson will be 24 next month.

Tolson and Simmons' arrests follows that of Jamarkos Campbell, 23, who was arrested in April for the murders. Campbell is in the Daviess County Detention Center. Sources have told The Interior Journal that detectives were waiting to arrest other suspects until Campbell was moved from Lincoln County.

Shangraw and Upton were killed when at least four masked individuals entered Shangraw's rented mobile home in the Hubble community and shot them to death.

The case remains under investigation and more arrests are expected.
