Former Garrard clerk's case goes to grand jury

LANCASTER - A Garrard County grand jury heard part of the case against former Circuit Court Clerk Jennifer Grubbs on Wednesday, though the outcome won't be revealed until next month.

Madison County Commonwealth's Attorney David Smith appeared before the grand jury Wednesday but said today he did not complete his presentation.

"I'm not quite finished yet," Smith said this morning. "I expect the grand jury will resolve this matter in March."

Smith said he wasn't necessarily seeking an indictment against Grubbs, but rather presenting his findings to the grand jury, which would decide if there was enough evidence to charge her with a crime.

Smith was appointed special prosecutor in the Grubbs case last month after the state Administrative Office of the Courts turned over the findings of its investigation to him.

Grubbs was suspended Dec. 16 by Supreme Court Chief Justice John Minton while an investigation was conducted.

AOC officials have declined to reveal the nature of the investigation, but Minton's announcement hinted that it might be focused on financial improprieties.

Grubbs retired on Dec. 31. She said her retirement was planned well before her suspension and that she didn't expect the investigation to turn up any wrongdoing.

Smith said Wednesday that the grand jury could decide to hand up an indictment charging Grubbs with a crime or issue a no true bill in the case, effectively clearing her of any wrongdoing.
