Judge dismisses whiskey bottle assault charges

A couple charged with beating a woman with a whiskey bottle, pumped their fists in the air when their charges were dismissed Wednesday afternoon.

Dionne Carmen, who swore out the warrants against 21-year-old Roy Gross Jr. and 25-year-old Shannon Johnson, didn’t appear for the couple’s preliminary hearing Wednesday afternoon in Clark District Court.

Clark County Attorney Brian Thomas said he had talked to Carmen’s husband before court, and was told that Carmen had been released from surgery Tuesday and that they would make every effort to be in court.

When the case was called and Carmen did not appear to testify, Clark District Judge Earl-Ray Neal amended the charges to criminal attempt and dismissed them. The charges were dismissed without prejudice, which allows them to be reinstated at a later date if need be.

According to Carmen’s warrant, she received a broken arm and was hit multiple times with a whiskey bottle by both Gross and Johnson. She claimed she was walking through their yard at 26 Seaboard St. when the couple attacked her.

In court documents, Gross and Johnson told police that Carmen showed up at their home and began yelling for them to come out. When they answered the door, they said Carmen began hitting herself in the face.
