After winning the Jessamine County Fair demolition derby small car division and receiving his trophy Wednesday night, David L. Warner Jr., 36, received something else — a set of handcuffs as Nicholasville police arrested him and charged him with DUI.

“He won the demolition derby in the small car division,” NPD Capt. Chris Cain said. “We had some complaints from officials and the crowd that he was drunk.”

When police began to investigate, Cain said Warner, whose listed address is 1620 Phillips Lane,  took a preliminary breath test but allegedly refused other field tests.

“He refused to blow in the breathalyzer tube,” Cain said. “The citation says, ‘I ain’t blowing in that (expletive) tube, so you can stick it up your (expletive).’”

Cain said even though Warner was competing in the demolition derby, an event that poses danger to the participants, doing so while allegedly drunk increases the risk.

“Even being in a demolition derby, there are some rules they have to follow, and being impaired can lead to more risks that what they are already taking by doing that,” Cain said.

According to an NPD news release, witnesses said Warner had consumed several Bud Light beers while he was preparing to drive in the derby.

Warner was booked in the Jessamine County Detention Center where he later bonded out, according to jail officials.

He is scheduled to appear in Jessamine District Court at 9 a.m. Tuesday, July 26.
