Former jail employee indicted on theft and forgery charges

Arraignment scheduled for Jan. 27

A former employee of the Jessamine County Detention Center has been charged with stealing money belonging to the detention center and forging notices of jail credit.

Brian Shearer, 35, 105 1/2 Cottage St., was indicted by a Jessamine County grand jury in December on 20 charges of theft by unlawful taking, value less than $500; four counts of theft by unlawful taking, value more than $500; and 15 counts of second-degree forgery, according to documents filed Dec. 9 in the Jessamine Circuit Clerk office. The thefts allegedly occurred “on or about” July 20 through Nov. 25, 2011, and the forgeries allegedly occurred according to the records.

Jessamine County Jailer Jon Sallee said the jail staff received a tip-off of possible suspicious activity in November. The jail then performed an internal investigation that took about a week and found enough probable cause to charge Shearer, Sallee said. After the initial investigation the case was turned over to the Kentucky State Police. Shearer allegedly took about $7,000, Sallee said. While the investigation was ongoing, Shearer was placed on administrative leave without pay, but has since resigned, Sallee said.

Shearer served as a captain at the jail where he performed various tasks and duties, Sallee said. According to the documents filed in the clerk’s office, Shearer committed the forgery offenses by forging information on notice of jail credit forms that were required to be filed by the Commonwealth of Kentucky Administrative Office of the Court.

The money did not come from a specific account, Sallee said, but declined to comment further about how they believe the money was taken.

Shearer has not spent any time in jail, as he was served a criminal summons. He is scheduled to appear in Jessamine County Circuit Court for arraignment in Judge Hunter Daugherty’s courtroom on Jan. 27 at 9 a.m.
