The estate of a Danville woman who lived in Arnold Towers has filed a lawsuit against the Housing Authority of Danville alleging a fall on the property led to her death.
The estate of Lois V. Cox, administered by Lois B. Arron, is seeking an unspecified amount of damages from the housing authority and Danville Mayor Bernie Hunstad.
The complaint, filed last week in Boyle Circuit Court, maintains that Cox died on Jan. 3, 2011, after she fell because of a poorly constructed or maintained railing that surrounds the outdoor areas of Arnold Towers.
Cox had to use the railing to enter her apartment, the lawsuit maintains.
The negligent construction or maintenance of the railing “caused and/or failed to prevent the fall of the decedent...which was the proximate cause of her death,” the lawsuit states.
Cox endured “extreme pain and suffering prior to her death; medical expenses, personal injury and loss of income,” the complaint maintains.
