Crab Orchard man indicted on assault charge for allegedly shooting his brother

STANFORD —  A Crab Orchard man accused of shooting his brother has been indicted by a Lincoln County grand jury.

Charlie Pelly, 38, of 8915 Ky. 643, was indicted for first-degree assault in the Nov. 28 shooting of David Pelly at the home Charlie Pelly shares with his mother.

According to police, David Pelly went to the home to check on a missing house payment. Charlie Pelly said he became worried his brother would start a fight, so he got a 9mm pistol and shot him in the chest, stomach and leg.

Charlie Pelly called 911 after the shooting and expressed remorse, but Sheriff Curt Folger said further investigation cast doubts on Pelly’s claim of self defense.

Pelly’s bond was set at $100,000. Folger testified before the grand jury.

Others indicted were:

  • James C. Strevels, 30, 6010 Ky. 695, Hustonville, alleged manufacturing of methamphetamine on Aug. 28. Bond was set at $40,000. Deputy Dewayne Taylor testified.
  • Timothy J. Kidd, 26, of Waynesburg, alleged possession of meth and promoting contraband at Lincoln County Regional Jail on Feb. 8. Bond was set at $25,000. Trooper Chris Damron testified.
  • Larry D. Yocum, 44, 228 Land of Goshen Road, alleged fourth-offense driving under the influence and driving on suspended license on Dec. 14. Bond was set at $25,000. Vehicle Enforcement Officer Matt Hutti testified.
  • Jackson T. Allison, 25, of Bronston, burglary for allegedly entering Andrew’s Automotive on Sept. 8 with the intent to commit a crime.  Bond was set at $20,000. Stanford Officer Rick Dye testified.
  • Charles Powell, 50, 619 Elm St., Crab Orchard, theft more than $500 for allegedly taking property belonging to Robert Benge on Dec. 23, 2010. Bond was set at $5,000. Deputy John Williams testified.
  • Phillip W. Brown, 50, 118 Berry Lane, Hustonville, alleged trafficking in morphine on July 26. Bond was set at $25,000. KSP Detective Keith Addison testified.
  • Lora L. Board, 45, 615 B. Goshen Cutoff Road, alleged trafficking in oxycodone on Feb. 9 and March 10. Bond was set at $50,000. Addison testified.
  • Brian W. Ison, 32, of Lancaster, alleged trafficking in cocaine on March 25 and April 4. Bond was set at $50,000. Addison testified.
  • Jasper McCann, 29, of Waynesburg, alleged trafficking in oxycodone on Nov. 28. Bond was set at $25,000. Folger testified.
  • Brandy G. Conder, 27, of 285 Halls Gap Estates, theft of a controlled substance for allegedly taking medication belonging to Jackie Wilson on Aug. 30. Bond was set at $10,000. Folger testified.
  • Robert L. Boyd Jr., 33, of Junction City, flagrant nonsupport for allegedly falling $6,338 behind in child support payments. Bond was set at $6,000. Dana M. Gander testified.
  • John Hensley, 54, of Manchester, flagrant nonsupport for allegedly falling $11,569 behind in child support payments. Bond was set at $11,000. Gander testified.
  • Franklin Herring, 29, of Brodhead. flagrant nonsupport for allegedly falling $6,397 behind in child support payments. Bond was set at $6,000. Gander testified.
  • Michael W. Kessinger, 27, of Crab Orchard, flagrant nonsupport for allegedly falling $12,478 behind in child support payments. Bond was set at $12,000. Gander testified.
