Married couple indicted by grand jury for possession of slot machines, promoting gambling

Ernest DeMoss and his wife, Deborah, have been indicted by a Jessamine County grand jury for first-degree promoting gambling and possession of gambling records and devices.

The indictments stem from a Nicholasville police raid March 13 at Sew Chic, a business located at 922 S. Main St. No arrests were made at that time.  

Law enforcement confiscated 16 slot machines after executing a search warrant on the building they suspected illegal gambling had been taking place, Nicholasville Police Department officer Kevin Grimes said. 

The building was leased by Nicholson Property to Ernest DeMoss, Grime said.

The grand jury indicted the couple jointly on three separate counts based on evidence from the NPD.  

The first count states there was enough evidence to support the charge that "they knowingly advanced and profited from unlawful gambling activities." 

The second count states "they possessed writings and papers commonly used in the operation of a bookmaking scheme or lottery or mutual scheme."

The third indictment states "they possessed gambling devices."

A motion to set aside a warrant of arrest was granted, and the couple has put up property in lieu of bond. 

Both Ernest and Deborah DeMoss are represented by attorney David Marshall and have signed a waiver of conflict of interest as a married couple.  

A motion for discovery has been filed, a jury trial date has been set for 8:30 a.m. Aug. 29.
